Description of Publication:The Medical Malpractices of China have different characters from regular torts, which were mingled with objective disputes and interest disputes, while the contemporary tort-based litigation system fails to meet these characters to resolve those conflicts. Since the People’s Mediation Act was promulgated, many people’s mediation institutions were organized by local government to resolve medical malpractices. To patients, mediation can decrease costs and avoid the inaccuracy of litigation; to hospitals and doctors, mediation can provide an incentive to reduce medical negligence, preserve the doctor-patient relationship whenever possible; to government, mediation can optimize managing efficiency. Due to the advantages of mediation, the author argues that many of problems of medical malpractice litigation can be alleviated through the simple use of mediation. Therefore, some arrangements on mediation should be taken into serious consideration for fulfilling equity justice.
